These Terms govern your use of the Varta application at varta.sizhitsolutions.com (the "Service"), operated by SIZH IT SOLUTIONS PVT LTD, a company registered in India ("we", "us"). By creating an account or using the Service you agree to these Terms.
Varta is a WhatsApp Business messaging dashboard. It allows a business to connect its own WhatsApp Business account and to send and receive customer messages, manage message templates and view conversation history.
To use the messaging features you authorise Varta, through Meta's Embedded Signup, to access your WhatsApp Business Account on your behalf. You confirm that you own or are authorised to manage that account and the phone number registered to it. You may disconnect the integration at any time from the dashboard.
Your use of the Service must comply with the WhatsApp Business Messaging Policy, the WhatsApp Business Solution Terms, the Meta Platform Terms and Meta's Developer Policies. In particular you must:
Breach of these policies may result in suspension of your account by us, or of your WhatsApp Business account by Meta.
You must not: attempt to gain unauthorised access to the Service or its infrastructure; reverse engineer, copy or resell the Service; interfere with its operation; scrape or extract data by automated means; or use it to store or transmit malware.
You remain responsible for the customer data you process through the Service and for having a lawful basis to do so. Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
Paid plans are billed in advance at the rates stated at the time of purchase. Messaging charges levied by Meta for WhatsApp conversations are separate and are your responsibility. Fees are non-refundable except where required by law.
We aim to keep the Service available but do not guarantee uninterrupted operation. The Service depends on the WhatsApp Business API and may be affected by changes, outages or restrictions imposed by Meta. We may suspend access for maintenance or security reasons.
The Service, including its software, design and content, remains the property of SIZH IT SOLUTIONS PVT LTD. You receive a limited, non-exclusive, non-transferable right to use it for the duration of your subscription. Content you upload remains yours.
You may close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by Meta, or if required by law. On termination your data is deleted in accordance with the retention periods in the Privacy Policy.
The Service is provided "as is" without warranties of any kind to the extent permitted by law. We are not liable for indirect or consequential loss, loss of profits, or loss of data. Our total liability in any 12-month period is limited to the fees you paid for the Service in that period. Nothing in these Terms limits liability that cannot be limited by law.
You will indemnify us against claims arising from your misuse of the Service, your breach of these Terms, or your breach of Meta or WhatsApp policies.
We may update these Terms. Material changes will be notified in the dashboard or by email before they take effect. Continued use after that date constitutes acceptance.
These Terms are governed by the laws of India, and the courts of New Delhi have exclusive jurisdiction.
